Labor Law – CDT’s legal assistance for the Italian company leader in the production of applications and embroidery on luxury bags, shoes and accessories for most of top luxury-fashion brands
CDT has assisted the Tuscan company, which is the partner-supplier chosen by most of top luxury-fashion brands, for the creation and production of applications and embroidery, accessories and jewelry for high fashion, for luxury bags, shoes and accessories.
A former employee of the Company had appealed to the court to argue:
- the illegitimacy of the fixed term employment contract:
Due to failure to specify the justifying reason;
Due to lack of correspondence between the tasks indicated in the employment contract and those to which she was assigned;
- the illegitimacy of the extension of the fixed-term employment contract for failure to specify the justifying reason;
- the violation of the right of precedence In permanent hiring;
- be placed in a higher level, because the former employee had carried out tasks higher than those of the contractual framework.
For these reasons the former employee asked to the court the conversion of the permanent employment relationship, with obligation for the Company to reintegrate her in the workplace.
The court has rejected all claims by the employee.
